Often regarded as the wide
boy of the business world, marketing has often run close to the legal and
moral boundaries. For many years this has been tolerated by customers and
businesses alike who see the constant push at these boundaries as a sign of
a healthy and dynamic marketing team.
Times are changing as the
legal and financial penalties start to bite.
In February 2006 Wanadoo
was reprimanded for claiming download speeds of 8 megabytes when the service
was only available to 5% of the UK market. In December 2005 an out of court
settlement of £270 registered the first successful claim against an
unwanted e-mail. All the signs are that marketers who flout the law will
receive swift reproach by customers and the legal process.
